Most buyers will arrange for a licensed property inspector to examine your property within the timeframe specified in the purchase agreement. If the purchase agreement is contingent upon financing, a licensed appraiser will assess the property’s value on behalf of the lending institution to ensure their investment is sound. Buyers of commercial properties may also require an environmental audit or soil testing, depending on the lender’s requirements.

The Role of the Closing Agent

A title company or attorney will serve as the closing agent, responsible for verifying and insuring clear title to the property. They will conduct a thorough examination of the property’s recorded history, certifying that: 1) your title is free from encumbrances (such as mortgages, leases, or liens) by the closing date; and 2) all new encumbrances are properly recorded in the title.

Understanding Contingencies

A contingency is a condition that must be fulfilled before a contract becomes legally binding. For example, a buyer might include a contingency that the agreement is only valid upon receiving a satisfactory home inspection report from a qualified inspector.

Before finalizing the purchase of your property, the buyer will review all aspects specified in the purchase agreements and any applicable addendums. This includes:

  • Securing financing and insurance
  • Reviewing essential documents, such as preliminary title reports and disclosures
  • Conducting property inspections, which may cover roofing, termite/pest issues, chimney/fireplace checks, boundary surveys, and more.

Based on the results of these inspections, one of two outcomes will occur:

  1. Each milestone is successfully met, allowing contingencies to be removed and moving closer to closing.
  2. The buyer may request a renegotiation of the contract terms, often concerning the price, after reviewing the property and documentation.
